Which service do I need?

Most people don’t come to us looking for a service. They come with something that happened to them. Here are the most common situations, and where to start.

“I was hurt in a car accident.” Whether you were a driver, passenger, pedestrian, or cyclist, and whether or not the other driver was insured or identified, start with Motor Vehicle Accidents.

“I slipped or tripped and fell.” Ice, wet floors, broken stairs, and poor lighting are covered under Slip and Fall Injuries. These claims have short notice deadlines, so contact us quickly.

“I was injured on someone else’s property, but I didn’t fall.” Falling objects, unsafe railings, inadequate security, and injuries in rental buildings come under Occupier’s Liability.

“A dog bit or attacked me or my child.” Ontario holds dog owners strictly liable. See Dog Attack Injuries.

“My doctor or hospital made a mistake.” A missed diagnosis, surgical error, medication error, or birth injury may be a claim. See Medical Malpractice.

“My long-term disability, CPP Disability, or ODSP claim was denied or cut off.” All three are covered under Disability Benefits. Denials carry appeal deadlines measured in weeks, so don’t wait.

“I’m not sure which of these applies.” Contact us anyway. The first consultation is free, and many injuries involve more than one type of claim at once.

How we work

We start with a free consultation: You tell us what happened, what your injuries are, and what you have heard from the insurer so far. There is no charge and no obligation.

We give you an honest assessment: If your claim is strong, we’ll tell you. If it’s weak, or the deadlines have passed, we’ll tell you that too. We would rather turn a file away than give you false hope.

You pay nothing unless we recover: Personal injury files are handled on a contingency fee: our fee is a percentage of what we recover, and if we recover nothing you owe no legal fee. Our maximum contingency fee percentage is 33% of the amount recovered. The details are set out in the Law Society of Ontario standard form agreement, which we review with you before you sign.

We deal with the insurers: From the first notice to the final settlement, the insurance companies deal with us, not you. You focus on treatment and recovery.

We keep you informed: You hear from us at every stage, and you work directly with the lawyer on your file.

Common questions

How much does it cost to hire you? Nothing up front. The initial consultation is free, and our fee is a percentage of what we recover for you. If there is no recovery, there is no legal fee.

How long do I have to start a claim? In most Ontario injury cases, two years from the date of the injury or the date you discovered it. Some claims require written notice much sooner, within days for municipal sidewalks and within weeks for snow and ice, and disability appeals have their own short deadlines. Contact us as early as you can.

Will I have to go to court? Most personal injury claims settle without a trial, often at mediation. We prepare every file as if it will go to trial, which is usually what produces a fair settlement.

What if I was partly at fault? You can still recover. Ontario reduces your compensation by your share of responsibility rather than eliminating it, and insurers routinely overstate that share.

What should I bring to the first consultation? Anything you have: accident or incident reports, photographs, medical records or discharge papers, correspondence from the insurer, and the names of any witnesses. If you don’t have much yet, come anyway.
